INDIANAPOLIS: Indianapolis-based Eli Lilly has won a trademark lawsuit in Europe against Spanish drug company Ratiopharm over misusing the coloration of Lilly's Prozac brand to identify one of its own drugs. Lilly said that Ratiopharm was using the same color combination, green and cream, on one of its brands of capsules, confusing it with Lilly's successful antidepressant, Prozac. A court in Madrid has ordered Ratiopharm to cease the practice immediately. "These types of lawsuits are important for patients as well as the company," said an Eli Lilly company spokesman. "We're always interested in protecting our trademark so patients are aware of the identities of their medication."
